An error displayed in a portal and a formal assessment can sound similar when described verbally. They require different responses. Save the full document and ask which authority issued it, what it demands and when notification occurred before selecting a procedure.

Prepare the decision file

  1. Complete notice, attachments, reference, issuer and taxpayer RFC.
  2. Notification evidence and applicable dispatch, opening and effective dates.
  3. Returns, XML invoices, contracts and payments for the disputed period.
  4. A chronology of previous requests with submission receipts.

Federal Tax Code article 38 sets requirements for administrative acts requiring notification. A typographical error alone does not establish that a notice has no effect. Article 2 of the Federal Law of Taxpayer Rights covers information, assistance and respectful treatment among other rights.

Informal contact does not automatically suspend deadlines

Do not treat a call, email, clarification or complaint as an automatic suspension of a deadline to comply or challenge an act. Confirm the rule for the particular act and remedy with the person reviewing the file.

Example: the same amount, different procedures

One taxpayer has an unrecognized payment in a compliance opinion. Another received a formal assessment for that amount. The first may need evidence that the payment was applied. The second also needs review of the assessment, notification and challenge route. Giving both the same clarification form could leave a legal deadline unattended.

Agree on the scope of assistance

Ask who will review the act, monitor dates, file documents and deliver the final evidence. A quote covering clarification may exclude court proceedings. Identify that limit and responsibility for new notices before engaging the service.

Frequently asked questions

Does every discrepancy require a lawyer?

Some accounting discrepancies can be addressed through review and clarification. A challengeable resolution or rights dispute may require legal assistance. Decide from the document and consequence.

Will a complaint cancel a tax assessment?

That result is not guaranteed. Reviewing rights and determining the correct tax amount are different questions. Keep the identified deadlines under control while the remedy is assessed.
